Terms of Service
Effective date: August 14, 2026
These terms are an agreement between you and Living Beyond LLC, a Georgia (USA) limited liability company ("LivingScene," "we," "us"). They govern your use of the LivingScene desktop app, the LivingScene websites and customer dashboard, and everything else we offer under the LivingScene name (together, the "Services").
By creating an account or using the Services, you agree to these terms. If you don't agree, don't use the Services. If you're using LivingScene on behalf of a company or other organization, you're agreeing on its behalf and "you" means that organization too.
We've written these in plain English on purpose. Questions? support@livingscene.ai.
1. What LivingScene is
LivingScene is a desktop app for creating and giving presentations that stay alive — scenes that are interactive and current when you present them, not frozen the moment you stop editing. The Services also include your account dashboard, where you manage your subscription, and our documentation site.
Your decks are files on your device. We don't host or store your presentation content — see §6 and our Privacy Policy for what that means in practice.
2. Your account
To use LivingScene you need an account. You agree to:
- give us a real email address that you control, and keep it current;
- keep your password and sign-in credentials secure — what happens under your account is your responsibility, and if you suspect someone else is using it, tell us right away;
- be at least 13 years old (if you're under 18, you need a parent or guardian's permission).
One person, one account, one free trial. Don't create accounts for anyone but yourself (or your organization), and don't create accounts by automated means.
3. Free trial
New accounts get a 14-day free trial of the paid features. You don't need a payment method to start. If you add one, your subscription begins when the trial ends; if you don't, the trial simply expires — no charge, no surprise. One free trial per person.
4. Subscriptions, billing, and cancellation
Billing. Paid plans are billed monthly, in advance, at the price shown when you subscribe. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms for payment processing. Where required, taxes are added at checkout.
Renewal. Subscriptions renew automatically each month until you cancel.
Cancellation. You can cancel anytime from your account's billing portal. Cancellation takes effect at the end of your current billing period: you keep paid access until then, and you aren't charged again.
Refunds. Because you can try LivingScene free before paying and cancel anytime, we don't give refunds or credits for partial billing periods — except where the law requires, or where these terms say otherwise (see §11: if we end your subscription without cause or discontinue the Services, we refund the unused portion of what you've paid).
Price changes. If we change a price, we'll email you at least 30 days before it affects you, and it takes effect at your next renewal after that notice. If you don't want to pay the new price, cancel before it takes effect.
Failed payments. If a renewal payment fails, we may retry it and email you. If it keeps failing, your subscription may be paused or canceled.
5. Some features require a subscription
Free accounts and expired trials can use the Services in a limited way; some features require an active paid subscription. We'll always be clear in the product about which is which.
6. Your content
You own it. Everything you create with LivingScene — decks, scenes, and what's in them — is yours. These terms don't give us any ownership of your content, ever.
It lives on your device. LivingScene stores your decks locally. We don't keep copies, which also means we can't recover a deleted or lost deck for you — please keep backups of work you care about.
Processing you ask for. Some things you do send content off your device at your direction — for example, AI features send deck content through our AI service to our model provider (§7), and sharing an exported scene file gives its contents to whoever you share it with. Where content passes through systems we operate, you give us permission to process it as needed to provide the Services to you — nothing more.
Your responsibility. You're responsible for your content: that you have the rights to use what you put in your decks, and that what you share doesn't break the law or anyone's rights.
7. AI features
AI features are included with LivingScene — you don't need an account or API key with any AI provider. When you invoke an AI feature, your instructions and the content of the deck you're working on are sent through our AI service to our model provider to fulfill your request; the app confines AI access to the deck you're editing. What happens to that content (short version: processed, not stored, never used to train models) is in the Privacy Policy.
- Usage limits. AI usage is subject to fair, plan-based limits that keep the service fast and sustainable for everyone. We'll be transparent in the product about any limits that apply, and we may adjust them over time.
- AI output can be wrong. Review what it produces before you rely on it or present it. You're responsible for what you present, including AI-assisted parts.
- Providers may change. We may change AI providers or models, or how AI features are delivered — if how your content is handled changes, we'll update these terms and the Privacy Policy first.
8. The desktop app
We give you a personal (or internal-business), non-exclusive, non-transferable license to install and use the LivingScene desktop app on devices you control, for as long as you have an account in good standing. The app may check for and install updates so you're running a current, secure version.
Don't reverse-engineer, decompile, or tamper with the app or its licensing and subscription checks, except where the law expressly permits it despite this term.
9. Acceptable use
Be normal. Specifically, don't:
- use the Services to break the law, or put unlawful content in decks you share;
- probe, disrupt, or overload our systems, or access them by automated means (except public APIs or feeds we document);
- circumvent subscription checks, share account credentials, or resell access to the Services;
- misrepresent LivingScene as the author of what you present, or use our name, logo, or brand in a way that suggests we endorse you without our permission.
If something you're doing feels like it needs a lawyer's opinion on whether it's allowed, ask us first: support@livingscene.ai.
10. Privacy and usage analytics
Our Privacy Policy explains what we collect and why — including the desktop app's feature-level usage analytics, which never include your content and which you can turn off in Settings at any time. The Privacy Policy is part of the deal between us.
11. Ending things
You can leave anytime. Cancel your subscription (§4), stop using the Services, and delete your account whenever you like.
We can act on breach. If you materially breach these terms, we may suspend or terminate your access — with notice and a chance to fix it where that's practicable, immediately where it isn't (for example, abuse of our systems). No refund is owed for a termination for breach.
If we end it without cause. If we terminate your account without cause or discontinue the Services, we'll give you reasonable notice and refund the unused portion of anything you've prepaid.
What survives. Sections that by their nature should survive (your content ownership, disclaimers, liability limits, disputes) survive account closure. Your decks are local files, so they remain on your device regardless of what happens to your account.
12. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Services will be uninterrupted, error-free, or that AI output will be accurate or fit for your purpose.
Presentations are often high-stakes. Test your deck before the big moment; don't let the demo gods find you unprepared.
13. Limitation of liability
To the fullest extent the law allows: we're not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill — even if we've been told they're possible. Our total liability for all claims arising out of or relating to the Services is capped at the greater of $50 or the amounts you paid us in the 12 months before the claim arose.
Some places don't allow certain limitations; where that's you, these apply only as far as the law permits. Nothing here limits liability that can't legally be limited.
14. Indemnity
If a third party brings a claim against us because of your content, your breach of these terms, or your unlawful use of the Services, you agree to defend and indemnify us against it. We'll tell you promptly about any such claim and reasonably cooperate with you.
15. Changes to the Services and these terms
LivingScene will evolve — we may add, change, or retire features. If we make a material change to these terms, we'll tell you by email or in the product at least 14 days before it takes effect; continuing to use the Services after that means you accept the change. The current version always lives at this page, with its effective date at the top.
16. Governing law and disputes
These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules.
If something goes wrong, email support@livingscene.ai first — most problems are fixable without formalities, and we both agree to try in good faith for 30 days before filing anything. After that, disputes belong exclusively to the state or federal courts located in Georgia, and we each consent to their jurisdiction. Either of us may instead use small-claims court where the claim qualifies.
17. The fine print
- Entire agreement. These terms plus the Privacy Policy are the whole agreement between us about the Services, and they replace any earlier understandings.
- Severability. If a court finds part of these terms unenforceable, the rest stands.
- No waiver. If we don't enforce a term today, we can still enforce it tomorrow.
- Assignment. You may not assign these terms. We may assign them as part of a merger, acquisition, or sale of assets — the terms still protect you either way.
- Export & sanctions. You may not use the Services in violation of US export-control or sanctions laws.
- Force majeure. Neither of us is liable for delays caused by things genuinely outside our control.
